How long does it take to get a divorce in Tennessee?
The minimum statutory waiting period for a divorce based on irreconcilable differences is 60 days after filing if there are no minor children and 90 days after filing if the couple have minor children. Irreconcilable differences is the only no-fault divorce in Tennessee and is usually the basis for an uncontested divorce. Contested Divorces can be lengthy and costly.
How do I get a divorce in Tennessee?
For an uncontested divorce:
Your attorney drafts all of the necessary documents and then files the Divorce Complaint and related documents with the court and serves the other spouse.
A Marital Dissolution Agreement is reached between the parties and signed by both
If there are minor children, a Permanent Parenting Plan and Child Support Worksheet are submitted to the court.
Your divorce is set on the court’s uncontested docket for a hearing before the Judge.
A short hearing is held and if the Judge approves the divorce complaint, permanent parenting plan and child support plan, a Final Decree is entered.
For a contested divorce:
Your attorney drafts all of the necessary documents and then files the Divorce Complaint and related documents with the court and serves the other spouse.
The other spouse has 30 days to file an Answer.
Interrogatories, Request For Production of Documents are exchanged, and Depositions are scheduled.
Pre-Trial Motions are argued before the court.
A Trial is held
The Final Decree is issued, granting or denying the divorce and stating the grounds relied upon. The Final Decree also includes a division of property and child custody and support issues.
